TERMS OF SERVICE

As the client, you are expected to read these terms before purchasing a custom commission. By commissioning me, you agree to my Terms of Service.

1. IMPORTANT INFORMATION

 

I will NOT do business with a client under 18 years of age for NSFW content of any nature. Any attempt to bypass this rule will be blacklisted from my services.

The client is expected to be clear about what they want in their commission. References must include the following:

 

• Images of the character, preferably full body images. Anything that contains their face, body type, and/or hair style and length is acceptable. If the character comes from a video game, screenshots will suffice.

• A list or visual reference of tattoos, scars, or jewelery the character may have. Text references are acceptable.

• If the character comes from WoW, please include the name of their armorset and a link to their WoW Armory (this counts only if I am asked to draw them wearing their current armorset.

• Links to images are fine, so long as they do not lead to galleries, and the links are not broken.

 

I will NOT redo commissions for free. If you wish a commission to be redone, you will need to commission me again.

 

Example prices do not always apply. Depending on the complexity of your commission, the price may be higher than what is listed. The example prices are simply a standard.

Communication is essential. Lack of communication can result in lower quality in a client's commission if they are not clear with what they want. A client remaining unresponsive after several attempts of communication without warning will have their commission cancelled and refunded, if it is not complete.

 

Clients will recieve WIPs of their commission in their email, and are required to reply to these emails with acknowledgement that they were recieved. Progress on any commission will cease until the client replies with their input on the WIP.

If the client does not point out any errors in the WIPs, then demand a refund after the piece has been complete, the client will NOT receive a refund or a redo. The client is expected to point out any errors before the piece is completed.

 

Art is non-refundable once it is complete.

 

I will not do private commissions. All commissions are posted to my social media accounts publicly. You can, however, request to have your name omitted from the posts instead.

 

2. PAYMENT

 

Do NOT send me any payment until I have confirmed that I have accepted your commission. I will notify the client when it is appropriate to send payment.

 

The client is expected to pay upfront. I will not start any commissions without payment.

 

I will only accept payment in USD (United States Dollars)

 

PayPal is the only acceptable form of payment. No exceptions.

 

DO NOT SEND PAYMENTS LABELLED AS "GIFT". It is illegal to send payment as a gift for services, and it is illegal for me to accept them. Doing so violates PayPal's Acceptable Use Policy. I will send you an invoice, and you are required to pay for the service there.

 

Clients have 48 hours to pay for their commission. Failure to pay within this time span will result in their commission being cancelled and their slot forfeited. If you need more time to make payment, please let me know so that we can make accommodations.

 

3. AS THE ARTIST

 

I reserve all rights to my artwork granted onto me by US Copyright Law and the Moral Right regardless of the characters depicted. The client assigns all rights to the artist.

 

I retain the right to repost the finished piece for self-promotion.

 

I reserve the right to issue takedown notices of edited versions of the art should the client violate my Terms, or if I feel my Moral Right to an image has been compromised.

 

I reserve the right to cancel and issue a refund to any commission at any time. Should this happen, the client will lose all rights to the cancelled image.

 

I reserve the right to refuse my services to anyone.

 

4. AS THE CLIENT

 

The "client" refers to the person who has sent payment.

Visible credit must be given to me (the artist) if my work is reposted onto other websites. If the client does not give credit, they will be asked to add it or remove the artwork. If the client refuses to remove my artwork after not posting proper credit, I will contact the website to have it removed.

 

The client retains all rights to their characters depicted. I do not take claim to any character I am asked to draw.

 

The client is not to claim the artwork is their own. The credit belongs to me, as the artist, and if I discover the client claiming that the artwork I produced in a commission is their own, the client will be viewed as an art theft, and will be blacklisted from any future commission work.

 

The client may cancel the commission at any time. I will issue a refund for work not completed. Refunds for completed work, however, are not available.

 

5. SUBJECT MATTER

 

A commissioner that is trying to purchase art of characters that do not belong to them will require written permission from the owner of that character. Exceptions may include characters from a TV show, video game, movie, etc.

 

I have the right to refuse any commission for any given reason.

I will draw NSFW material to a certain extent. Anything too explicit will be denied. Major fetishes, incestual themed or pedophiliac themed images will NOT be accepted.

I will only draw copyrighted or trademarked content on a case-by-case basis.

I will not draw any kind of art that I deem as a misrepresentation of groups such as trans, nonbinary, intersex individuals, LGBT+ individuals, or any other group of people.

I will draw gore on a case-by-case basis.
